What it can do

  • By-laws for the reserve (Indian Act s. 81)

Makes by-laws for its reserves: health of residents, traffic, law and order, nuisances, animals, roads, water supplies and other local works, zoning and buildings, allotment of reserve land, residence on the reserve, wildlife and fish on the reserve, and trespass. Fines of up to $1,000.

  • Money by-laws and local taxation (Indian Act s. 83)

With the Minister's approval, taxes land and interests in land on the reserve for local purposes, licenses businesses, and spends band money. Many First Nations tax property under the First Nations Fiscal Management Act instead.

  • Intoxicant by-laws (Indian Act s. 85.1)

With the consent of a majority of electors voting at a special band meeting, may prohibit the sale, supply, manufacture or possession of intoxicants on the reserve.

  • Membership code (Indian Act s. 10)

Decides who belongs to the First Nation under its own membership rules, adopted by a majority of its electors.
